A certification label helps a health IT buyer identify a product's program status, but it cannot describe every later development. ONC's final oversight rule, published October 19, 2016, made that distinction commercially relevant. It created a direct review framework for certified health IT and expanded the public availability of surveillance results. Its effective date was December 19, not the day purchasers first read the rule. [onc-release][2016-24908]
The agency's October 14 explanation described notices that would reach customers during correction and following certification suspension or termination. That mattered to information available on both sides of a sale: a developer knew its remediation plan, while a customer needed to know whether its own installation was affected. ONC said status changes would also appear on its certified products list. [onc-release][2016-24908]
The final rule sharpened the incentive. During suspension, developers had to stop marketing, licensing and selling the affected product as certified under the program. Suspension could occur on a reasonable belief of serious public health or safety risk; proposed termination had grounds including failed cooperation or corrective obligations. These were consequences for certification, not a finding that every customer must instantly replace every connected application. [onc-release][2016-24908]
For procurement teams, our practical inference is to distinguish current certification, an unresolved problem and the evidence supporting its correction. A purchasing decision based only on an earlier label could miss those differences. The announcement and rule belong to one ONC policy chain. Neither established lower switching costs, stronger competition or vendor revenue losses by this coverage date; those would require separate evidence. [onc-release][2016-24908]
