Mortgage businesses assessing the CFPB’s servicing changes face a sequencing problem before an outcome story. The October 19, 2016 main rule generally takes effect October 19, 2017, with specified exceptions on April 19, 2018. This October 22 weekend reading is explicitly prior-week context, not evidence of another rule or an immediate compliance change on Saturday. [2016-18901][2016-18902]
Part VI of the main rule puts successor-in-interest provisions and bankruptcy periodic statements on the later timetable. Other changes include insurance notices, early intervention and loss-mitigation procedures. Our planning inference is that a business needs to assign work by provision rather than treat the longest implementation period as permission to delay the whole package. The rule does not supply a measured firm-level cost estimate for that decision. [2016-18901][2016-18902]
The companion interpretation changes the liability analysis only in defined situations: compliant communications with confirmed successors, required modified written early-intervention notices and borrower-initiated loss-mitigation exchanges. It does not create a market-wide right to contact borrowers after a cease-communication request. In particular, unrelated collection demands do not acquire protection merely because a conversation began as loss mitigation. [2016-18901][2016-18902]
The companion generally takes effect October 19, 2017, while its successor interpretation starts April 19, 2018. Our incentive reading is that narrow protections can reduce uncertainty about specified conduct without removing responsibility for how the conduct occurs. Neither document proves lower servicing costs, improved competition or fewer defaults. Both are CFPB products in the same policy chain, so they cannot serve as independent confirmations of commercial benefits. [2016-18901][2016-18902]
