A network of service providers can coordinate assistance without making every client’s identity available across the network. That distinction is built into the November 2, 2016 final Family Violence Prevention and Services Act rule. It promotes coordination among community organizations, states, tribes and coalitions while imposing confidentiality requirements on funded grantees and subgrantees. The relevant resource is not only funding; it is also control over sensitive information. [2016-26063]
The October 2015 proposal explains why unrestricted sharing would carry an external cost. Information that identifies or locates a victim could reach a perpetrator or someone assisting one. The agency therefore framed confidentiality as a safety safeguard and contemplated nonidentifying aggregate reporting. This rationale challenges the assumption that easier data exchange is always an improvement, even when organizations share a legitimate service mission. [2016-26063][2015-25726]
The final text permits aggregate, nonidentifying service and demographic information for reporting, evaluation or data collection requirements. Identifying information operates under a different framework of consent and specified exceptions. A provider cannot make a person’s agreement to release that information a condition of eligibility. When release is compelled by statute or court mandate, notice efforts and privacy and safety protections are required. [2016-26063]
These boundaries suggest a practical test for coordination: distinguish information needed to assess a program from information that exposes an individual. That is an analytical implication, not a claim that a particular network redesigned its operations. The rule’s effective date is January 3, 2017. Both retained documents come from one government rulemaking chain; they establish neither realized efficiency gains nor enough shelter capacity to meet every request. [2016-26063][2015-25726]
