Ranking can influence airline choice before a traveler reaches the purchase page. In its November 3, 2016 final passenger-protection rule, the Transportation Department addresses that mechanism by prohibiting undisclosed carrier-identity preferences in covered electronic displays. The rule reaches specified systems combining multiple carriers’ schedule, fare or availability information for the U.S. market. It does not simply declare every commercial ranking arrangement unlawful. [2016-26178]

The May 2014 proposal illuminates a related distribution problem. DOT proposed sharing basic ancillary-fee information with ticket agents so consumers could better compare total travel costs. The final November action did not settle that proposal: fee-disclosure questions were reserved for further rulemaking. The distinction matters because disclosure of a ranking preference and access to price components solve different information problems. [2016-26178][2014-11993]

The final display rule requires prominent notice of covered carrier-based bias and protects the prominence of options best matching user-selected criteria. Yet section 256.6 expressly avoids requiring access to internal reservation systems, permission to scrape websites or distribution of an airline’s services through a particular agent. Transparency at the display layer is therefore not the same as a universal right to obtain or sell inventory. [2016-26178]

The stated effective date is December 5, 2016; additional performance reporting follows a separate schedule beginning with 2018 operations. A plausible competitive benefit is that disclosed preferences are easier to distinguish from search relevance, but the documents do not measure that benefit. They are one DOT rulemaking chain, not independent evidence that competition improved. The unresolved test is whether better presentation changes choices without being mistaken for complete market coverage. [2016-26178][2014-11993]
