Comparing prepaid accounts requires more than knowing their purchase price. The CFPB’s final rule, published November 22, 2016, paired a short disclosure of important fees and information with a long disclosure listing all account fees and their conditions. The agency framed the short form as a tool for understanding key terms and comparing prepaid programs. [2016-24503][2014-27286]
The December 23, 2014 proposal had already outlined that two-level approach. It contemplated key-fee information before acquisition, fuller fee detail, and conditional alternatives for accounts sold by telephone or in stores. The final retained a general requirement for both forms before acquisition, with an alternative timing regime for the long form in qualifying retail and telephone transactions. The earlier document supplies design history, not independent evidence that comparison improved. [2016-24503][2014-27286]
Account agreements added another information channel. The final required issuers to post agreements offered to the general public on their own websites, with access on request for account holders whose agreements were not posted. For counselors helping users compare terms, a fee display and an agreement answer different questions. More accessible terms are a mechanism for informed choice, not proof that prices fell or switching became effortless. [2016-24503][2014-27286]
Remedies also changed from the proposal: the final extended limited liability and error resolution regardless of verification, while exempting unverified accounts from provisional credit. These distinctions belong alongside price comparisons, since account terms include risk as well as fees. Defined exclusions, including gift cards, limit scope. The published schedule generally began October 1, 2017, with section 1005.19(b) following in 2018; this evidence does not measure later competition. [2016-24503][2014-27286]
