A regulatory route to investment is different from an investment paying off. The FCC's December 1, 2016 broadcast foreign-ownership rule extended streamlined procedures and revised public-company ownership assessment. Its market mechanism was procedural: make the route for evaluating ownership less burdensome. The documents did not establish that broadcasters had raised more capital or that audiences had gained more competitive choices. [2016-28198]
The November 2015 proposal clarifies that mechanism. The FCC sought comment on using carrier procedures for broadcasters and changing the assessment of the 25 percent foreign-ownership benchmark. It was considering how the process should work, not offering an enacted waiver. The proposal and final belong to the same policy chain, so their stated burden-reduction rationale is not independent evidence of cost savings. [2015-28344][2016-28198]
The final framework preserved the 20 percent limit at the licensee level and the separate 25 percent benchmark for a controlling U.S. parent. Investment above the latter could be permitted through public-interest review. That distinction creates room for a petition, not unrestricted access. Specific approval conditions for foreign investors and control interests also remained; nominally small stakes did not supply a universal escape from review. [2016-28198]
The stated general effective date was January 30, 2017, with identified information-collection provisions awaiting OMB approval and a later notice. Investors could therefore assess an adopted procedural design without assuming every component was immediately operative. Whether it would lower transaction friction while preserving meaningful scrutiny was the economic question still to test, not a result established by publication. [2016-28198]
