HUD’s smoke-free public-housing rule addresses costs that can fall outside an individual smoking decision. The agency expects improvements in indoor air quality, lower fire risk and reduced maintenance costs. Its December 5, 2016 publication establishes the policy mechanism, not a balance sheet showing savings already achieved. That distinction matters when a regulation is justified partly through operating costs. [2016-28986][2015-29346]
The mechanism is spatial: prohibited tobacco use is restricted in covered living units, common interiors and agency offices, with a 25-foot buffer outside housing and administrative buildings. Burning tobacco and hookahs are included. Dwelling units in mixed-finance projects and Section 8 assistance are excluded from the operative scope, limiting how broadly those incentives can be attributed to this federal action. [2016-28986][2015-29346]
The November 17, 2015 proposal had already advanced the perimeter and an 18-month implementation window after effectiveness of a final rule. That history shows a planned transition, not evidence of an economic payoff. The adopted rule specified February 3, 2017 effectiveness. Proposal and final rule are stages of one HUD process, rather than independent support for the projected benefits. [2016-28986][2015-29346]
Implementation has costs of its own. HUD identifies training, administration, legal work and enforcement among possible agency expenses. Agencies must also change plans and leases, with resident engagement and public meetings in the planning process. A useful economic assessment would compare those burdens with actual subsequent changes in maintenance and risk. Neither the proposal nor the final rule supplies that outcome comparison, and neither supports a promised dollar saving for a particular property. [2016-28986][2015-29346]
