Insurance planning depends partly on distinguishing an unknown decision from an unknown process. Treasury’s December 7, 2016 interim final rule makes the terrorism-certification process more explicit through public notices, but rejects a strict overall certification deadline. The mechanism can tell market participants whether review is underway without turning an uncertain determination into a scheduled cash receipt. [2016-29313][2016-06920]

The initial notice is due within 30 days after the Secretary starts review, not after the underlying incident. If timely notification is impracticable, Treasury can issue it as soon as practicable in an appropriate manner. A reader cannot therefore take the incident date, add a month and assume either certification or payment must follow. The notice itself is expressly nonbinding as a final determination. [2016-29313][2016-06920]

The April 1 proposal had a wider financial and administrative scope, including civil penalties and final netting of payments. December’s interim action addresses only certification procedure, reserving the broader revision for later. That difference matters for interpreting the scope of regulatory certainty: finalizing a communication process does not finalize every proposed Program rule. These documents trace one Treasury rulemaking rather than independently demonstrate a market response. [2016-29313][2016-06920]

The interim rule specified January 6, 2017 for effectiveness and written comments. The economic question is whether clearer status information can help participants distinguish procedural delay from a substantive determination. The sources do not quantify that value, establish lower premiums or show a change in available coverage. They provide a map of notices, not an investment recommendation or a guarantee of compensation. [2016-29313][2016-06920]
