A seafood supplier's price is not the only input a U.S. importer must assess under NMFS's December 9, 2016 framework. For covered products, the importer needs harvest information and a documented chain of custody. That creates an information requirement alongside the commercial transaction: a shipment's paperwork must support entry reporting and remain available when authorities inspect or audit the records. The February proposal had described the same basic incentive mechanism: permits and harvest-to-entry information could help authorities exclude illegally sourced products and check fraud. The final established the reporting and retention duties. In market terms, substantiating origin could matter alongside price, but the two agency documents do not show a measured reduction in illegal competition or a net saving for compliant firms. The final design also limited how much matching it demanded. Aggregated harvest reports were allowed, and each portion of a shipment did not have to be connected to an individual harvest event. Certain products without technically or economically feasible species or harvest identification were excluded. Those details matter to the cost question; describing the rule as universal item-level tracking would exaggerate its stated requirements. [2016-29324][2016-02216]
The importer of record had to retain entry and custody information for two years from import, not submit every custody document electronically at entry. The published calendar set January 9, 2017 effectiveness and January 1, 2018 compliance for the initial species, with shrimp and abalone deferred. The competitive outcome remained unmeasured: a recordkeeping obligation creates work, while its enforcement value depends on usable evidence and follow-through. [2016-29324][2016-02216]
