Recruitment rules can change who gets considered without creating a single new training place. That is the useful economic distinction in the Labor Department’s December 19, 2016 registered-apprenticeship rule. It adds protected bases and directs covered sponsors to address barriers through affirmative action. Any claim that this has already increased hiring would go beyond the documents. [2016-29910]

The final text treats affirmative action as more than paperwork: sponsors examine recruitment, selection and advancement practices, alongside analyses of their apprentice workforce. The incentive-based interpretation is that a sponsor must look at how its process affects access, rather than rely only on a general assurance of fairness. This is a reading of the mechanism, not a measured productivity effect. [2016-29910]

The November 6, 2015 proposal supplies a counterweight to a uniform-burden account. It described existing affirmative-action-program exemptions for fewer-than-five programs and qualifying approved arrangements. The final rule retains a conditional small-program exemption, excluding circumvention; basic nondiscrimination still applies. Scale can therefore change particular administrative duties without making discriminatory recruitment an acceptable competitive strategy. [2015-27316][2016-29910]

The relevant market is U.S. registered apprenticeship, not all employer training. The final additions include age 40 or older, genetic information, sexual orientation and disability. Its original January 18, 2017 effective date comes with section-specific transitions. Viewed over Christmas weekend, the proposal and final rule show one policy process balancing access and administration, not independent evidence of lower costs, more entrants or additional jobs.
