The economically interesting part of CBP's December 27, 2016 chemical import rule is not simply that a form can travel electronically. A firm still has to determine what it is declaring. Positive TSCA certification asserts compliance with applicable rules and orders; negative certification concerns chemicals outside the law. Sending the wrong assertion faster is not the mechanism the rule is designed to reward. [2016-31055]
The August proposal laid out those different meanings and the special treatment of chemicals within articles, where certification depends on a TSCA rule or order. That explanation makes the remaining task visible: a submission channel cannot decide the scope of the Toxic Substances Control Act for a shipment. Proposal and final action are one policy chain, not separate evidence that firms saved money. [2016-20546][2016-31055]
The final text removes negative certification for clearly identified TSCA-excluded chemicals and ends the paper blanket process. CBP explained that the old blanket certificate was limited to one port for one year and still required an entry-level reference. Removing that arrangement targets a specific administrative duplication, rather than waiving the substantive compliance assertion for covered chemicals. [2016-31055]
Electronic filing remains optional, with entry-specific written certification available. CBP stated January 26, 2017 as the effective date. The agency anticipated lower reporting burdens, but the two documents do not measure realized savings. For an importer assessing the change, the useful separation is between fewer steps in transmitting a declaration and the work needed to make that declaration accurate. [2016-31055][2016-20546]
