Maintaining competence is an ongoing obligation in EPA's January 4, 2017 restricted-use pesticide rule, not a one-time certificate purchase. The final framework sets a maximum five-year recertification interval for commercial and private applicators. Certifying authorities must develop programs to maintain competence, using examinations, training or a combination rather than treating one method as universally sufficient. [2016-30332]
The operational side also matters. Certified supervisors must be certified in the categories relevant to the applications they supervise and verify noncertified users' qualifications. Immediate communication must be available. For an enterprise organizing work, this makes the match between supervision, qualifications and the intended application central; the rule does not establish the business's actual training bill or any productivity gain. [2016-30332]
The August 2015 proposal had pursued training and supervision changes and proposed age 18 across certified and supervised noncertified applicators. The final rule adds a limited age-16 exception for noncertified users directly supervised by an immediate-family private applicator. It excludes fumigants, sodium cyanide, sodium fluoroacetate and aerial use. These paired documents show an adjustment within EPA's process, not independent market evidence or a broad permission to substitute younger labor. [2016-30332][2015-19988]
Transition shapes the planning horizon. The original effective date is March 6, 2017, but existing certification plans continue for three years. Timely amendments can preserve them during review for up to two more years unless EPA authorizes an extension, with implementation set in approval. The relevant economic question is how programs deliver sustained competence under those conditions, not whether publication instantly changed every applicator's costs. The scope remains restricted-use pesticides. [2016-30332]
