A licensing application becomes a different commercial proposition when the default review policy shifts from denial to approval. Commerce made that change for specified Sudan aviation and railway exports on January 17, 2017. It did not remove the application requirement. That leaves an economically important distinction between making an opportunity more plausible and making entry frictionless. [2017-00844][2017-00836]
The favorable policy covered eligible items controlled only for anti-terrorism reasons, for civil uses by non-sensitive end users. Complete aircraft remained outside it. Applications substantially benefiting sensitive users, including military, police and intelligence services, would generally be denied. Product classification and the identity of the ultimate beneficiary therefore still defined the opening; a transport label alone was insufficient. [2017-00844][2017-00836]
Treasury's coordinated rule supplied the financial side. It authorized transactions under its Sudanese sanctions regulations and named executive orders, including transactions needed to release previously blocked funds. Other sanctions and export requirements survived, along with enforcement exposure for earlier violations. A more favorable Commerce policy could not substitute for those separate legal boundaries, and Treasury authorization could not replace a required export license. [2017-00844][2017-00836]
Agricultural and medical shipments also retained a twelve-month clock beginning with contract signing, rather than an automatic annual expiry of Treasury's general license. The documents show changed permissions and incentives, not observed orders, lower prices or realized savings. The market question left open is whether eligible transactions could proceed on workable terms after those remaining conditions were taken into account. [2017-00844][2017-00836]
