Repeated legal questions can consume administrative effort even when each appeal has its own facts. HHS’s January 17, 2017 Medicare appeals rule gave the Departmental Appeals Board chair a selective precedent-setting role. Recurring issues, broad application or impact and public interest could inform which Medicare Appeals Council decisions received that designation. The mechanism was selection, not automatic authority for every decision. [2016-32058]
Its economic interest is predictability: resolving a recurring legal issue through designated precedent could reduce uncertainty about later treatment. That is a prospective implication, not a measured saving. HHS separately projected that assigning defined non-hearing decisions, withdrawal dismissals, specified remands and dismissal reviews to attorney adjudicators could redirect about 24,500 appeals annually, with lower processing costs than using judges for that workload. [2016-32058]
The proposal and final rule also recorded the capacity problem at different dates. July’s proposal reported more than 750,000 pending appeals on April 30, 2016, against annual capacity of 77,000. January’s final reported more than 650,000 pending on September 30 and approximately 92,000 annual capacity. Those snapshots are not a before-and-after test of the January reform. [2016-32058][2016-15192]
The scheduled effective date was March 20, 2017. The relevant test would distinguish the costs of handling assigned tasks from the timeliness and consistency of the wider process. A redirected appeal is not necessarily a resolved appeal, and an appeal is not a unique patient. These records establish HHS’s incentive and workload design within one proceeding, not its realized returns. [2016-32058][2016-15192]
