Closing enrollment earlier changes when a person can act on new information about medical needs. In its February 17, 2017 proposal, CMS argued that ending 2018 Exchange enrollment on December 15, 2017 would reduce opportunities to join after learning that services were needed late in December or January. That was its adverse-selection rationale, not evidence of a realized market improvement. [2017-03027]

The March 2016 final rule provides the relevant counterfactual calendar: enrollment for the 2018 benefit year would continue from November 1, 2017 through January 31, 2018. A November 1–December 15 window was already scheduled for 2019 and later benefit years. CMS now proposed advancing that shorter window to 2018. The mechanism concerned timing of entry, not a limit on policy duration. [2017-03027][2016-04439]

The incentive story ran in both directions. CMS acknowledged that younger, healthier people who typically enrolled late might be lost under a shorter window. Fewer opportunities for need-driven late entry could therefore coexist with fewer comparatively healthy entrants. Its impact analysis also identified potential enrollment losses from inadequate assistance and longer waits. A deadline alone could not establish which effect would dominate. [2017-03027]

The operational argument was separate: selections by December 15 already carried a January 1 effective date, and CMS expected the proposed schedule to simplify insurer and Exchange processes. Additional outreach might still cost money. Read together, the baseline and proposal identify timing, participation and administration as distinct parts of the economic question. They are one agency evidence chain, not independent proof of lower premiums or a stronger risk pool. [2017-03027][2016-04439]
