Commerce chose not to reshuffle gas-turbine engine clamps into a different subparagraph when finalizing its November 21, 2016 export-control rule. Instead, it placed clamps of all types in Commerce Control List entry 9A619.y.5 and fluid-system check valves in 9A619.y.9. The agency said the proposed arrangement would have caused unnecessary reclassifications. This November 27 retrospective examines that earlier decision. [2016-27777]

The change addressed a specific administrative mechanism: keeping clamps together rather than moving them to accommodate a newly listed type of valve. It was not an exemption for every clamp. The final clamp provision concerned commodities controlled in entry 9A619 or defense articles in Munitions List Category XIX, within the entry’s specially-designed and not-elsewhere-specified limits. [2016-27777]

Commerce also declined to apply the same approach indiscriminately to aircraft clamps. It explained that some aircraft clamps carry significant loads, while engine clamps generally do not, and retained different treatment for those aircraft items. For suppliers, the useful commercial distinction is between avoiding a needless change of subparagraph and eliminating a substantive control. The first was the agency’s stated reason; the second was not the decision. [2016-27777]

State’s companion rule revised Category XIX for gas turbine engines and associated equipment, alongside Category VIII for aircraft. Those retained State boundaries help define the scope of Commerce’s component entries. Both rules specified December 31, 2016 effectiveness and form one policy chain, not independent evidence of savings. The texts explain why a particular reclassification was avoided without measuring suppliers’ costs, sales or competitive gains. [2016-27775][2016-27777]
